(Acuista.com from now on) either by telephone, email or through our virtual stores, the BONACUISTA STORES, by professionals, COMPANIES, consumers, users or any kind of end user (THE USER), to whom orders may be delivered within the Spanish territory or abroad as described in clause 6. The usage of the services provided by the Acuista.com store presupposes that in any event the USER has adhered to the version of the General Terms and Conditions published by Acuista at the time of placing the order request, which is a available to customers on the website. Therefore we advise our customers to carefully read our General Terms and Conditions before placing an order request. 2. Prices, payment methods, deliveries, availability and product returns
2.1. Prices - All prices displayed on screen below each product are stated in Euros and may include taxes or not as indicated. In the shopping basket the total amount to pay excluding taxes is displayed separately, along with the applicable shipping costs. Shipping costs are NOT included in product prices, as they will be calculated based on the number of products selected and the final delivery destination. 2.2. Payment methods - All the Order Requests that Acuista.com has accepted may be paid by a wire transfer to any of the bank accounts provided by Acuista.com. Should the USER wish so, it's also possible to pay an order in advance, when placing an order request, either by PayPal or any of the following credit cards: VISA, MasterCard or any other credit card mentioned in the basket. In this case the USER accepts that PayPal or the bank operating the payment gateway will charge in advance the total amount indicated in the Shopping Basket. An additional handling fee will be charged when paying through credit card or PayPal whose amount is detailed in the basket. For security reasons, in case the personal details provided to Acuista.com differ from the ones in the PayPal account used, Acuista.com reserves the right of refusing the payment and cancelling the Order Request, especially if there is strong evidence that the buyer is not the PayPal account holder. For security reasons, Acuista.com may request the USER to submit a copy of an identification card or any other document proving the identity of the USER when paying by credit card, either manually or online. Acuista.com reserves the right of refusing the payment and cancelling the Order Request, if there is reasonable doubt that the buyer is not the provided credit card holder and the USER refuses to use an alternative payment method after having been informed. The USER may cancel any ORDER REQUEST before his ORDER being confirmed. Should the ORDER be already confirmed, either by email or by any other means of communication, the conditions stated in paragraph 2.4 of these General Terms and Conditions will be applied.
2.3. Deliveries and Availability- Expected delivery times published in Acuista.com depend on the products and the warehouses where they are stored. The expected delivery time can be found in product detail pages. Once the payment for an order has been confirmed and the availability of the requested products have been confirmed, the orders will be dispatched from Acuista.com's warehouses or wholesalers to the delivery address provided by the USER, within 1-2 business days. Should the USER not receive the ORDER within the delivery time published in the product detail pages, please contact our Customer Service either by phone 902 23 23 34 or email at servicioclientes@acuista.com. Acuista.com will do everything possible to meet the specified delivery time and if I have learned that for whatever reason will not be met as communicate via e-mail or phone to the USER. All efforts will be made by Acuista.com to ensure that the delivery times are met and in the event of being unable to do so, the USER will be promptly informed by phone or email. Acuista.com will do everything possible but CAN NOT GUARANTEE that, unless otherwise stated, the USER will receive the products within 4 days in mainland Spain and the Balearics and within 2 weeks in the Canary Islands, Ceuta and Melilla from the date the products are shipped from the warehouse. Most products will be delivered by specialized carriers. In the event that the USER requires a faster delivery service, and only if it is possible to offer such service, Acuista.com will do the necessary arrangements and will inform the USER of the additional costs associated with the service. Some products can only be delivered to mainland Spain and The Balearic Islands. Upon receiving an Order Request from a zone where it is not possible to dispatch the requested products, Acuista.com will promptly inform the USER. Sometimes, in orders including more than one product, different shippings can be arranged. A single delivery with all the available products or two deliveries: one with the currently available products and a second one with the remaining products once they become available. In the second case, the USER will have to pay for the additional cost of the second delivery.
In Acuista.com a product is marked as available if their providers have confirmed there is available stock in their warehouses. The availability information is automatically daily updated in the morning and, unless otherwise stated, it is not updated until the following day. Under some circumstances, like the demand of a product exceeding our expectations, a product may not available while placing an order request. Acuista.com customer service staff will inform the USER of the unavailability of a product as soon as we receive this information from our supplier. The USER may decide to cancel the order request or request an alternative product with similar characteristics.
Acuista.com does not own any warehouses, the product availability displayed is based on the information provided by our suppliers, this is why Acuista.com is no liable for any errors that may occur in the communication of such information or for possible stock-outs that can be generated due to high demand for a product.
In any case, the user will be promptly informed of the unavailability of the product. Should the USER not wish to be offered an alternative, a reimbursement will be issued for any payment received within 5 days. In the event that the payment is not reimbursed within 30 days, the USER can claim to be paid twice the amount due, without prejudice to their right to be compensated for the damages suffered as excess of this amount.
2.4. Refunds and Right to cancellation - The USER can exercise their right of cancellation and return any product in accordance with the current Distance Selling Regulations. Any return, cancellation or revocation of the contract of sale must be made by sending the Cancellation or Revocation document attached to these General Terms and Conditions to Acuista or by any means permitted by law, and in any case, returning the products received. In the event that the cancellation or revocation is requested before the USER receiving the PRODUCT and consequently the Cancellation or Revocation document, the USER must contact Acuista.com in order to exercise his right to cancellation or resolution of the operation. To prevent the illegal reproduction of multimedia products (video games, CD-ROM, etc..), only originally sealed or defective products returns will be accepted. This is why the USER needs to contact Customer Service staff and detail the reasons for the return. In all cases, provided that the right of cancellation is exercised within 14 working days of receiving the order, Acuista.com will issue a credit note and reimburse the total amount of the purchase and the shipping costs. The USER will have to pay the shipping costs for returning the PRODUCT. Refunds shall be paid within 5 days of the reception of the returned ORDER. In the event of a USER receiving a broken, damaged or in poor condition PRODUCT, Acuista.com will collect the faulty product and replace it at NO additional cost. Acuista.com may terminate the contract before the product is delivered to the USER only if there are strong reasons to believe that the payment method used in the purchase was illegal or invalid. In this case Acuista.com will contact the USER and offer an alternative for the suspected irregularity.
2.5. Acuista Outlet - Acuista.com Outlet (OUTLET from now on) is a private section of Acuista.com available to USERS that have signed up in that section. The OUTLET organises campaign sales of refurbished second hand and in some cases, new items, from the best brands, with significant discounts on the original recommended retail price (MSRP) of the manufacturer. Number of units for sale is limited and each campaign is available for a limited time.
An Acuista.com registered USER will only have to enter his email and password to sign up for the OUTLET section. Registering in the OUTLET the USER accepts to receive communications about forthcoming campaigns. The protection of personal details of registered USERS in the OUTLET is governed by section 3 of these General Terms and Conditions.
Once a campaign begins, the customer will be able to directly buy on-line. Prices will be revealed once the campaign starts. Product details, available quantity and the discount that will be applied over the original price will always be displayed.
3. Personal details protection - In accordance with the Law on the Protection of Personal Details, all the details that have been have willingly provided by the USER will be processed and incorporated into Acuista.com's automatic files. In case the USER provide details to request product information or about Acuista.com's services or any other matter different than customer / supplier relationship, we understand that the USER give us his/her full consent to process the provided personal details, as detailed in the Protection of Personal Details Law. It will be understood that this conditions are fully accepted once the button "SEND" next to the conditions check box is clicked. The information provided by the USER will be used by Acuista.com for the following purposes: i) sending the information expressly requested. ii) Sending regular newsletter about store information, products or Acuista.com services news. In any case, the USER can exercise at any time his/her right of access, rectification, cancellation and opposition of the provided information, in accordance with current legislation. Industrial and intellectual property - The intellectual property rights over the work (photographic, literary, audiovisual, etc..), BRANDS and logos contained in Acuista.com websites are held exclusively by Acuista.com , unless stated differently. Reproduction, distribution, commercialization or transformation of said work constitutes infringement of intellectual property rights from Acuista.com or the copyright holders and may lead to the exercise of any judicial or extrajudicial actions they may be entitled in the exercise of their rights. Furthermore, the information which can be accessed through this websites may be protected by intellectual property rights or others. Acuista will not be liable in any case and under no circumstances of infringement of such rights that a USER may commit.
5. Guarantees - The guarantee of the products sold by Acuista.com is 2 years for home users as envisaged by the text of the Law for the Protection of Consumers and Users and Other Laws. The guarantee of some consumables (printer consumables, spare bulbs, batteries etc.) will be limited to the period of its life, which is indicated by the manufacturer (3, 6 or 12 months). The warranty for corporate users is the policy established by each manufacturer. The guarantee for used products will be 1 year as envisaged by the text of the Law for the Protection of Consumers and Users and Other Laws. Specifically, when the USER wants to exercise their right to the warranty, the USER will be able to choose between the repair or the replacement of the goods (unless one of these options is impossible or disproportionate), or alternatively between a price reduction or a termination of the contract, all under the terms and conditions set forth in the warranties legislation for consumer goods and other regulations applicable in each case. Acuista.com will be responsible for any lack of conformity of the product during the terms and conditions established by law. Similarly, the USER is subject to compliance with the requirements and deadlines prescribed by law for the exercise of these rights. In addition, Article 123.4 of the General Law on Protection of Consumers and Users states: "The consumer and user must inform the seller of the lack of conformity within two months after knowing of it."
6. International Sales - All sales outside the Spanish territory are subject to special shipping costs that will be calculated by Acuista.com staff based on the weight and volume of the products requested by the USER after receiving an Order Request. International shipping costs published in the website are merely indicative and approximately correspond to send by regular surface post a package of about 5 kg. In the event that the automatically calculated shipping costs were incorrect, the USER will receive the correct shipping costs after sending the order request, at which time the USER will have to confirm or cancel the operation. On the other hand, purchases by individuals domiciled in any EU countries are subject to applicable taxes. Purchases made by the taxpayers on any of the EU countries will be exempt provided they send in advance a written copy of their Tax Identification Number. Purchases made by individuals, both physical and legal residents of countries outside the European Union, the Canary Islands and Ceuta and Melilla are exempted from VAT. Any expenditure that would accrue due to custom rates for the transportation of the products of the country of origin to the destination will be charged to the client if not otherwise agreed. All international sales shall be subject to all the provisions of these General Conditions unless some of the provisions contradict the law of the country of origin of the USER.
7. Applicable law and jurisdiction - These Terms are governed by the Spanish law. As an entity attached to CONFIANZA ONLINE and in terms of its Code of Ethics, in case of disputes regarding contracts and online advertising, data protection, child protection and accessibility, the USER can use the out-of-court dispute settlement system by CONFIANZA ONLINE (www.confianzaonline.es). In addition, for the settlement of any disputes arising from this contract or legal act, the parties may refer to the Consumer Arbitration Board of Catalonia, who is entrusted with the appointment of the arbitrator or arbitrators and the arbitration administration. In the event that none of the above systems proves to be effective, companies shall submit the dispute to the Courts and Tribunals of Barcelona and expressly renounce to any other jurisdiction that might correspond to them, while consumers shall submit the dispute to the courts and tribunals of the consumer's residence.

Once a return request has been accepted, the USER must follow the instructions provided by BONACUISTA and handle the return as indicated, CARRIAGE-PAID or not, to the location provided by BONACUISTA. All products must be returned in their original packaging. BONACUISTA reserves the right to impose a penalty in the event that an unwanted product is not returned in perfect condition. 7. Applicable law and jurisdiction - For the settlement of any disputes arising from this contract or legal act, companies shall submit the dispute to the Courts and Tribunals of Barcelona and expressly renounce to any other jurisdiction that might correspond to them.
The date of these conditions will be the one that appears in the associated invoice.
